These terms and conditions govern the access and use of the website www.porventura.pt, responsibility of the PORVENTURA brand owned by FGV Furniture Design, Lda, with headquarters at Rua Professor Hugo Correia Pardal, nº7, 6000-267 Castelo Branco, PORTUGAL (hereafter called PORVENTURA) by any user, as well as the conditions of the supply of the products that may be purchased by the Buyer, through this website. Any legal issues regarding the website can be found in our privacy and data treatment policy, associated with these terms and conditions.
The use of this website, exclusively for promotion and sale of PORVENTURA products online implies acceptance of these terms and conditions. By accessing the website, the user admits and accepts that the content may be incomplete, inaccurate, not updated or have mistakes, as well as may not meet its needs and requirements.
The contents of the website may be changed at any time or from time to time, without notice.
PORVENTURA adopted the appropriate technical and organizational measures to safeguard the security of the services rendered through the website, to ensure data integrity of email traffic related to not authorized use or knowledge, as well as to avoid the risk of dissemination, destruction or loss of data and information, confidential or not confidential, of its users in the website.
PORVENTURA cannot, nor will guarantee, that the website is free of viruses or of any other element that can negatively affect the technology used.
Access to the website will be continuous. However, it may be necessary to suspend, limit or discontinue such access at any time, regardless of the reason.

The website and all its contents, including, without limitation, articles, opinions, other texts, photographs, drawings, images, video or audio clips, as well as trademarks, logos, domain names, or any other source code elements that can be covered by intellectual property rights, are owned by PORVENTURA or third parties and are protected against the use, copying, or unauthorized disclosure, by national laws and by international treaties relating to Industrial property rights.

Users are advised to read and review the privacy and data processing policy to get to know how the website collects and uses the personal data of users and its purposes.
Guarantee
PORVENTURA is comitted to correct all defects resulting from design, implementation or assembly , within the limits of the following provisions:
This obligation does not apply in case of defects resulting from installation or inadequate usage conditions, which are the responsibility of the Buyer.
The warranty period of 24 months begins on the date of delivery of the product to the location indicated by the Buyer. In order to benefit from the guarantee offered, it is necessary to check the defect which is imputed to the supply, and inform PORVENTURA confirming in writing such information if the original communication was spoken. In its communication, the buyer must indicate both the references and the details essential for a quick evaluation of the defect. Once that PORVENTURA has been informed, it will provide the correction of the defect, with all diligence and responsibility. The responsibility is always limited to the value of the product, prior to the release of any tax. The refund will be made in equal payment mode, up to 10 (ten) days after receiving the returned product.
Complaints and returns
Returns, by complaint, due to defect resulting from design, implementation, assembly or transport incidents, should be carried out up to 14 (fourteen) days after the date of delivery and require prior acceptance about the shipment of the product to expertise, carried out by PORVENTURA. After acceptance, the product should be returned in its original packaging in good conditions so that it is possible to use again. The Buyer must keep the receipt of the return shipping so that it can get a refund of the shipping costs. PORVENTURA will not accept the return of the product, if it shows that it has already been used. The Buyer is responsible for the arrival of the goods in the same condition in which they were received.
The returns, for repentance, will have to be made up to five (5) days after the delivery date. The refund will be made, confirmed the condition of the product, in equal payment mode, up to 10 (ten) days after its reception and is always limited to the product's value before taxes. In this case, the return expenses will be borne by the Buyer.
Prices, taxes and customs
Retail prices are always meant in Euros for goods delivered on the premises indicated by PORVENTURA. In case of dispatch carried out by the first party, and in the absence of any stipulation of the contrary, the shipment is always made in postage paid upon arrival.
For countries of the European Community (EC), the prices contain the VAT of Portugal (23%) and do not include customs fees. Prices include the common packaging for ground transportation.
For countries outside the European Community (EC), prices do not include VAT, but there may be a need to pay taxes and additional fees, in the country of destination, by the Buyer. The packages are not included in the price, if the transportation is by sea or any other special form of transportation. In these situations, all transport operations, insurance and customs expenses are paid by the Buyer and the supplies travel by its own risk.
In case of dispatch carried out by PORVENTURA, and in the absence of any stipulation of the contrary, the shipment is always made in postage paid upon arrival. The packaging material should not be resumed.
The payment will be effected by VISA or AMERICAN EXPRESS credit card, PayPal or wire transfer, at book value, according to the terms of the sale, before the products leave the PORVENTURA premises.
Liability
It is expressly excluded PORVENTURA’s responsibility for any damages or losses, personal or property damage, caused to the Buyer or to third parties, even accidental, occurred due to the incorrect use of the product provided, or that result from conservation works, regarding, in particular, accidents with products which, due to their dimensions or weight, should be fixed to walls.
Jurisdiction
In the event of a dispute and to reach a friendly settlement, it is expressly agreed that all disputes relating to the contract with the Buyer, in Portugal, will be of the exclusive jurisdiction of the courts of the District of Lisbon, to the exclusion of any other, even in the event of appeal or of plurality of litigants.
In the case of the Buyer abroad, the dispute shall be subjected to the laws of the United Nations Convention on contracts for the international sale of Goods.
